ERNEST CAHILL DIED MAY 31, 1890. THE CIRCUMSTANCES ARE CLOUDED AND CAN BE FOUND IN THE NEWSPAPER ARTICLES WRITTEN AT THE TIME OF HIS DEATH.

ERNEST CAHILL, whose home was near Higby’s Station was run over by a Scioto Valley Train and killed Saturday night, at Mill Hollow not far from Higby’s. Cahill was intoxicated, and either fell upon the track and was too helpless to get up or unconscious of danger lay down to sleep at the point where he met his death.

Chillicothe newspaper- June 1890

ERNEST CAHILL, A FRANKLIN TOWNSHIP FARMER, KILLED BY A VALLEY TRAIN

ERNEST CAHILL, who lived on the Higby farm near Stony Creek, with his wife and four children, went to Higby Station on last Saturday evening for his mail and while there got in with a wedding party and absorbed more beer than he was able to carry.  Shortly before the North bound Valley Train was due he started up the track toward Home, but at Mill Hollow curve, for some reason or other, he laid or fell down on the track and when the Valley Train turned the curve at full speed, he was found fast asleep with his head and feet on the rails. The brakes were put on instantly and the engine reversed, but the train was too close to make the stop in time and the sleeping body of the unfortunate man was mangled under the wheels killing him instantly and making his body almost beyond recognition. The body was placed on the train by the railroad men and brought to this city and taken to Bonner’s undertaking establishment and Corner Kramer notified. After the body had been identified it was returned to the stricken home from which the funeral took place on Sunday.

Chillicothe newspaper- June 1890

CHARGED WITH MURDER AND ACQUITTED

Ever since the evening of May 31st, when the body of Ernest Cahill was mangled under the wheels of a north bound Valley Train, near Higby’s, there have been vague rumors to the effect that Mr. Cahill was not alive when the train passed over him. But had been murdered in cold blood and his body left on the track to cover suspicion. These rumors, which were merely suggestive at the beginning, grew as they passed mouth to mouth, a a little being added here and a little there until the relatives of the unfortunate Cahill began to believe that such was the case. Accordingly, on last Saturday, Aquillad Caldwell, a brother-in-law of the deceased came to this city and swore out a warrant Before ‘Squire Mick charging three men with murder in the first degree. Harry and Baillis Lawhorn and William Ravenscroft, all farmers who worked near Cahill in Franklin Township. These men were arrested on Saturday and on Wednesday a preliminary hearing was held before ‘Squire Mick, who adjourned his court to the room in the rear of the City Hall to accommodate the crowd.

Prosecutor Evans appeared for the State and Col. Entrekin for the defense. About twenty Witnesses were examined, and there being absolutely no evidence to hold any of the defendants they were all discharged. The defendants are all rather tough characters, and rumors first started found ready believers, and hence this farce, the costs of which the county will have to pay.

Chillicothe newspaper- June 1890

POSTSCRIPT:    However, the family of Ernest Cahill maintains that upon his deathbed, Bayliss Lawhorn confessed to the murder of said Ernest Cahill. The truth is known only to the men involved.
